After a flurry of challenges to the new 2024 Title IX Rules, injunctions applicable in 26 states mean that much of the country is continuing to operate under the 2020 Title IX Rules. And because the Supreme Court recently declined the Department of Education’s request to narrow those injunctions, we anticipate the 2020 Rules will remain in effect for schools in those 26 states for at least the rest of the 2024-25 school year.

Whether your Title IX team has been implementing the 2020 Rules for the last four years or includes new members just getting up to speed, renewed training is essential to successful implementation.

This half-day course provides all the training required by the 2020 Rules and will give Title IX Coordinators, deputy coordinators, investigators, decisionmakers, appellate decisionmakers, and informal resolution facilitators the basic knowledge and skills needed to play their roles.

Our T&H attorneys will cover the definition of sexual harassment; the scope of the district’s program and activity; how to conduct an investigation and implement the grievance process, including appeals and informal resolution; how to determine the relevance of questions and evidence; and how to serve impartially. In addition to walking through the nuts and bolts of the 2020 Rules, the training will provide examples and practical tips to prepare team members to handle reports of sexual harassment from beginning to end.

Remember, under the 2020 Rules, the investigator, decisionmaker, and appellate decisionmaker must be separate individuals, and each must be trained. Many districts have new personnel serving in these roles this year. Even for experienced personnel, continuing and updated training is key for competent implementation of the detailed 2020 Rules. This 3-hour virtual training is an efficient way to empower your team to address sexual harassment in a way that is compliant and effective.

If you are looking for more in-depth training under the 2020 Rules, basic or role-specific training under the 2024 Rules, or a guidebook to facilitate and document implementation of the grievance process, please reach out to titleix@thlaw.com for additional resources.
